KSBA Legal Service "awareness resource" keeps board attorneys and superintendents in the loop
KSBA Legal Services has published the Council Update on a periodic basis for more than a quarter of a century. The publication is furnished quarterly to members of the Kentucky Council of School Board Attorneys and features summaries of recently decided appellate school law cases. _Council Update _is copied to Kentucky superintendents as a courtesy and has been distributed electronically for the past several years.

“I do include United States Supreme Court and other important federal decision summaries when I put together the publication,” said John Fogle, the KSBA staff attorney who produces the service. “However, I place particular emphasis on Kentucky court decisions at both the state and federal levels which may not be flagged in the school law current awareness resources made available to our member attorneys via the National School Boards Association.

“The Update serves as a research aid to our Council of School Board Attorney members and gives superintendents a feel for the issues that are being litigated in our state. Our court rules were amended in 2007 to allow ‘unpublished’ state appellate court decisions to be cited to Kentucky courts when there are no published decisions covering the same issues. I review Kentucky case law databases to include the most relevant published, and unpublished, Kentucky school law decisions. My thinking is that this puts our school attorney members in a position to serve their boards more effectively,” Fogle said.
