Insurance is one of the most important and complex services that school districts purchase and
KSBA is providing resource materials to assist local decision makers navigate the process and obtain the best value. When it comes to insurance, cheapest does not necessarily mean best. Purchasing insurance is a sound business practice, but Kentucky Schools also are statutorily required to purchase certain coverages:
Workers’ Comp - KRS 342.340
Property - KRS 160.105 and 702 KAR 3:030
Auto - 702 KAR 5:030
To help districts that are weighing insurance coverage for 2013-2014, KSBA is providing two resources: a bidding guide and a model insurance bid specification, both attached below.
Retroactive date coverage language
It has been reported to KSBA that several Educator Legal Liability (ELL) insurance quotes have offered a July 1, 2013 retroactive coverage date, compared with the July 1, 1992 retroactive coverage date contained in the KSBIT policy.
ELL insurance coverage is written on a claims-made basis. It is important that districts – through their agents – negotiate an older retroactive date. Otherwise, any liability claims about wrongful acts occurring prior to July 1, 2013 would not be covered under such new policies. For any questions on these and any other insurance-related issues, please contact Myron Thompson at email@example.com or 1-800-372-2962.
